This set of Terms and Conditions is a legally binding contract between the company and the customer, for the services to be provided by the company and contains information about the procedures of Booking Confirmation, Payment, Refund System, Cancellation, and other charges levied as per policy.
Desire Adventures Pvt. Ltd. Terms and Conditions:
Booking:
The bookings are made for Desire Adventures Pvt—Ltd, registered under various departments of the Government of Nepal. The company is located in Tredevi Marg, Thamel, and Kathmandu. Mr. Dhurba Khanal is the Chairman of the Company.
The term “Trip” used in this website and booking conditions refer to all itineraries described on this website, including the itineraries of walking, tours, treks, trips, sightseeing, climbing, mountaineering, expeditions,s or holidays.
To confirm the booking, 15% of the total trip cost per person, along with a filled Booking Application Form is required. Known as the booking deposit, this amount is not refundable. The balance due amount i.e. 85% of the total cost is payable on arrival in Kathmandu, before departing for the trip destination. The final trip documentation will only be released after the payment of the remaining amount.
Payment Options and Method:
We offer both Bank Transfer and Credit Cards (Master/Visa/American Express/UnionPay/JCB/SCT Card.) bookings. Credit Card details should also be mentioned in the booking form if Credit Card is the preferred payment option of the customer. The remaining amount should be paid in cash, upon arrival in Kathmandu, before departing for the trip destination.

3.5% surcharge to all payments made via credit card. Surcharges apply to all payments: deposits, final balances, trip extensions, and miscellaneous purchases. The charge is imposed by the credit card payment service provider and is used, in part, to provide consumer protection for the services purchased, by the terms and conditions of the credit card being used.
(Note: An additional cost of USD 100, USD 150 is required for trips extending up to 10 days and more than 10 days, respectively, for a single room supplement and USD 200 for climbing/expedition.)
Cancellation:
No refunds will be made if the customer voluntarily leaves the trip for any reason, after the trip departure day. Refunds will be at the discretion of Desire Adventures Pvt. Ltd, if you are involuntarily forced to leave a trip for any reason. No refunds will be made for any accommodation, transport, sightseeing, meals, or services not utilized. However, these conditions are subject to change. The company reserves all rights to cancel any trip booked by you before it is guaranteed to run. A trip is guaranteed to run once it has two fully paid travelers unless minimum numbers state otherwise.
Under unavoidable circumstances like natural disasters, canceled flights, strikes, industrial action, wars, riots, quarantine, government intervention, weather and health conditions, or any other untoward occurrences, the company holds all rights to cancel any trip. If this occurs, 15% of the total amount remains non-refundable, but reusable for the immediately following season of the same year or the alternative trip of the same value. However, the remaining trip cost, which is 85% of the total trip cost, if already paid to the company will be refunded but there will be less than 13% Gov tax.
The company will require a written cancellation. Any amount already charged by the company is non-refundable. However, the same amount is reusable within one year from the booking date (Except for Luxury Trips). If the cancellation notice is received 1 month before the trip departure date, 100% of the total charged amount is reusable. 80% of the total charged amount is reusable, if the cancellation notice is received 30 days before the trip departure date and 50% is reusable in case of 15 days prior notice. However, the amount already charged by the company remains 100% non-refundable, if the cancellation notice is received 14 days prior to the trip departure date.
Trip Amendment:
USD 50 per person is required if the booking amendment request is received by the Company within 60 days or more. However, if the booking amendment request is received less than 60 days before your original trip departure, the charges will be as per the cancellation policy. In case of any changes in the price of the trip, within the time of the original booking and the amendment date, the new trip price will apply to the reservation. These fees are in addition to any charges levied by the hotels or any other service providers.
Changes to any other arrangements made in conjunction with your trip booking (e.g.; hotels, transfers, etc.) or amendments to any other arrangement made in conjunction with your trip reservation will incur an administration fee of USD20/booking per change. This fee is in addition to any charges levied by hotels, ground operators, or airlines.
It may not be possible to amend your booking within 10 days of departure. Fees for late changes will vary from the minimum of USD 50 and up per booking if the changes can be made.
Travel Insurance:
You need to get insured for medical and personal accident risks including medical coverage, air ambulance, and helicopter rescue services. Desire Adventures also strongly recommends that you take out cancellation insurance. You should be aware that some policies do not include, or restrict a cover for this type of travel. Make sure that the policy provides an adequate level of protection and covers you for the activities involved. You must carry proof of insurance (your insurance certificate) with you while on a holiday. However, if you are unable to provide this at the beginning of the holiday, you will be required to take out a suitable policy at that time. If this is not done or is impossible for practical reasons, then you will not be allowed to continue with your trip and will not be entitled to any refund for the services not provided.
Passport and Visa:
You must carry a valid passport and obtain the appropriate visa. Kindly ensure that your passport is valid for 6 months beyond the duration of the trip. Make sure to ensure that you have the correct visas for the countries you are traveling to. Desire Adventures is not responsible if you are refused entry to a country because you lack the correct visa documentation.
Facilities and Flexibility:
Nepal is a developing country rebuilding from the 2015 earthquake which made a huge impact on the country, economy as well as the citizen. You must understand that the accommodations, transportation, safety, hygiene, communication facilities, level of infrastructure development, and medical facilities are not the same as in your hometown. This type of holiday inherently involves a high level of personal risk, which you agree to fully assume.
During the trip, certain events may occur; accidents or illness in remote areas without medical facilities, political instability, and disasters are likely to occur. You agree to assume all risks associated with the journey to the maximum extent permitted by Nepalese law.
While traveling with Desire Adventure, you agree to accept the authority of the trip leader or local operator at all times. You are aware that travel within a group may involve compromise to accommodate the diverse desires and physical abilities of group members. You understand that the Company reserves all right to decline to accept or retain any person as a member of the group at any time if required.
You acknowledge that the Company contracts with a network of companies, government agencies, and individuals, to assist in the running of its tours, treks, walking, holidays & expeditions. To the best of the Company’s knowledge, these third parties are qualified to perform the duties they are contracted to perform. However, the Company will not be held responsible for any injury, damage, loss, delay, or irregularity caused by these third parties.
The Company will not take responsibility for any traveler, who contravenes any law or regulation of any country visited.
This agreement is governed by the laws of the Government of Nepal, therefore, no employee, representative, or agent of the Company has the authority to vary these conditions, except the head of the company or the director.
Most of the Trip prices exclude the following:
The trip cost includes all airport transfers. The head office of Desire Adventures in Kathmandu or a specified hotel (unless otherwise specified) will be your meeting point, before your departure.
Health Conditions :
All members of the group are required to be in good health and physical condition. The members with pre-existing medical problems or conditions must make these known to the Company, at the time of booking. Medical and evacuation expenses are the responsibility of the participants. All members of the group are required to consult their doctor for vaccination and other medical requirements for the trip, before their departure. The company reserves the right to require a medical certificate before booking the trip or departure.
Weather and other unfavorable conditions:
If trekking in the mountains, the weather in these regions is very unpredictable. Unfavorable weather conditions can cause domestic flight delays, particularly in the Everest, Jomsom, and Kanchenjunga regions in Nepal. Regarding delayed domestic flights, the Company will meet departing city accommodation and food costs before the trip, and accommodations and food costs on a normal trip basis for delayed return flights. The Company reserves all right to reroute treks or use road transportation for extended delays without any impact on the trip cost. The Company does not accept any responsibility for costs incurred as a result of missed international flight connection but will assist in making alternative arrangements where possible with extra cost. If any circumstances occur during the trek Altitude Mountain Sickness Company shall not take responsibility for damage caused by AMS as this is unpredictable.

The terms and conditions of all agreements made with the Company shall be subject to, and governed by Nepalese Law.
